SEALEGS LLC MAKES NO EXPRESS OR IMPLIED WARRANTIES, GUARANTEES, OR REPRESENTATIONS THAT WEATHER INFORMATION, FORECASTS, OR RECOMMENDATIONS WILL OCCUR OR HAVE OCCURRED AS DISPLAYED, PREDICTED, OR RECOMMENDED BY THE APP. SEALEGS LLC SHALL HAVE NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR ANY INCONSISTENCY, INACCURACY, OR OMISSION IN WEATHER OR MARINE CONDITIONS PREDICTED, DEPICTED, OR RECOMMENDED, WHETHER OR NOT SUCH CONDITIONS ACTUALLY OCCUR. WEATHER FORECASTS ARE PROBABILISTIC IN NATURE AND ACTUAL CONDITIONS MAY DIFFER MATERIALLY FROM PREDICTIONS.
MARINE WEATHER CONDITIONS CAN CHANGE RAPIDLY AND WITHOUT WARNING. Forecasts become less reliable as the prediction period extends further into the future. Conditions at sea may differ significantly from conditions at shore-based observation points. Users must monitor actual conditions continuously while on the water and be prepared to alter plans immediately based on observed weather, sea state, and other factors. A favorable forecast or 'go' recommendation does not guarantee safe conditions for the duration of any voyage.
THE VESSEL OPERATOR (CAPTAIN) IS SOLELY RESPONSIBLE FOR ALL NAVIGATION AND SAFETY DECISIONS. SeaLegsAI recommendations, including go, caution, and avoid designations, are decision-support tools only and do not replace the legal duty of the captain to ensure the safety of the vessel, crew, passengers, and property. The captain must independently verify conditions, exercise sound seamanship, and comply with all applicable maritime laws and regulations regardless of any recommendation provided by SeaLegsAI. Use of SeaLegsAI does not transfer, diminish, or satisfy any duty or responsibility imposed by law on the vessel operator.

SEALEGSAI IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEALEGS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEALEGS LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF SEALEGSAI, FROM ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY, SHALL BE LIMITED TO AND SHALL NOT EXCEED THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO SEALEGS LLC, IF ANY, DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM. IF YOU HAVE NOT PAID ANY AMOUNTS TO SEALEGS LLC DURING SUCH PERIOD, SEALEGS LLC'S TOTAL LIABILITY SHALL NOT EXCEED FIFTY DOLLARS ($50.00 USD).
Boating, sailing, fishing, and other marine activities are inherently dangerous and can result in serious injury, death, or property damage. By using SeaLegsAI, you expressly acknowledge and assume all risks associated with marine activities, including but not limited to: adverse weather conditions, changing sea states, equipment failure, navigational hazards, and the inherent uncertainty of weather forecasting. You agree that SeaLegs LLC shall not be responsible for any accidents, injuries, deaths, property damage, vessel damage, loss of cargo, delay, or any other consequences resulting from your use of SeaLegsAI or reliance on any forecast, recommendation, or information provided by the Services. You assume full responsibility for evaluating and bearing all risks associated with your marine activities.
You agree to indemnify, defend, and hold harmless SeaLegs LLC, its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of or reliance on the Services, including any recommendations, forecasts, or information provided; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any marine activity undertaken in connection with your use of SeaLegsAI. This indemnification obligation shall survive termination of these Terms and your use of the Services.
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You may stop using SeaLegsAI at any time and may delete your account through the app settings.
We may suspend or terminate your access to the Services if you violate these Terms or engage in prohibited activities.
