These Developer API & MCP Terms of Use ("API Terms") govern your access to and use of the SeaLegs AI developer interfaces provided by SeaLegs LLC ("SeaLegs LLC," "we," "our," or "us"), namely the SeaLegs AI Developer API at api.sealegs.ai and the SeaLegs AI Marine MCP server at mcp.sealegs.ai (together, the "APIs"), and of all data, forecasts, and AI analysis returned by them ("API Output").
By calling the APIs, creating a developer account or API key, or connecting an application or AI assistant to the APIs, you agree to these API Terms. If you are using the APIs on behalf of an organization, you agree on its behalf. If you do not agree, do not use the APIs.
These API Terms supplement, and do not replace, our general Terms of Service and Privacy Policy, which also apply. If they conflict, these API Terms govern your use of the APIs.
API Output is for general informational purposes only and is not suitable for navigation or any safety-critical use. Forecasts, tide predictions, observations, and AI analysis can be inaccurate, incomplete, or out of date, and marine conditions can change rapidly.
You assume the entire risk associated with use of the APIs and API Output. You agree not to present API Output to anyone in a way that suggests it is suitable for navigation or other safety-critical use, and to keep any safety notices included in API Output.
Subject to your continued compliance with these API Terms, SeaLegs LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to call the APIs and to use and display API Output in your own applications, websites, and AI assistants, including to answer your users' questions.
This license does not grant you any rights in the APIs' source code, models, or other intellectual property of SeaLegs LLC beyond what is required for that use. All rights not expressly granted are reserved.
Whenever you display, publish, or relay API Output to anyone other than yourself — including the users of your application, website, or AI assistant — you must:
attribution field, without removing or altering it.If you connect an AI assistant or agent to the APIs, you are responsible for configuring it so that it surfaces the attribution when it relays API Output to a person.
Some upstream data sources are licensed under terms that themselves require attribution — including Creative Commons Attribution 4.0 (CC BY 4.0), the Open Government Licence – Canada, and the Copernicus Marine Service licence. The attribution field is how we pass those requirements on to you; you agree to comply with them.
If you need to display API Output without SeaLegs AI branding, please contact us about a paid plan.
Answering your users' questions with the APIs is the intended use. You agree not to:
Some tools and endpoints require a developer API key. You are responsible for keeping your API keys confidential and for all activity and charges under your keys. Do not embed API keys in client-side code or share them with third parties. If you believe a key has been compromised, revoke it from your developer dashboard and contact us.
The APIs are subject to rate limits and quotas, which may differ by tier and may change. AI analysis is paid for with AI credits, priced as shown on our pricing page at the time of purchase. Credits are deducted when a request that spends credits is accepted.
We may change, update, suspend, deprecate, or discontinue the APIs — in whole or in part, including any endpoint, tool, parameter, or response field — at any time. We do not guarantee any specific level of uptime, latency, or availability. If you require a service-level commitment, please contact us.
API Output is derived in part from third-party and public data sources, including NOAA, the National Weather Service, Fisheries and Oceans Canada, Toitū Te Whenua Land Information New Zealand, DGFI-TUM (EOT20), NASA JPL, NOAA GLERL, the E.U. Copernicus Marine Service, EMODnet, GMRT, Open-Meteo, and Deutscher Wetterdienst. The sources used for a given response are named in its attribution field.
SeaLegs LLC is not affiliated with, endorsed by, or sponsored by any of these providers.
When you call the APIs, we receive your IP address, request metadata, and, where provided, your API key and the identity of your client application. We use this information to operate, secure, meter, and improve the APIs, including rate-limiting, billing, and abuse prevention. Our handling of personal information is described in our Privacy Policy. You are responsible for any disclosures to your own users required by applicable law.
THE APIS AND ALL API OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SEALEGS LLC DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT, AND MAKES NO WARRANTY THAT API OUTPUT WILL BE ACCURATE, TIMELY, OR SUITABLE FOR ANY PURPOSE — INCLUDING, WITHOUT LIMITATION, NAVIGATION OR ANY OTHER SAFETY-CRITICAL ACTIVITY.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SEALEGS LLC, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATING TO THE APIS OR API OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SEALEGS LLC'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE API TERMS OR THE APIS WILL NOT EXCEED THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO SEALEGS LLC FOR THE APIS DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY U.S. DOLLARS (US$50) IF YOU HAVE PAID NOTHING DURING THAT PERIOD.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, the limitations above apply to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless SeaLegs LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to (a) your applications, websites, or AI assistants, (b) your use of the APIs or API Output, including any presentation of API Output to others, (c) your violation of these API Terms or of any upstream data licence, or (d) your violation of any applicable law or any third-party right.
You may stop using the APIs at any time. SeaLegs LLC may suspend or terminate your access to the APIs, or revoke any API key, at any time and for any reason, including violation of these API Terms. On termination, you must stop calling the APIs. Sections 3 (Attribution, for API Output you continue to display), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and any other provision that by its nature should survive will survive termination.
These API Terms are governed by the laws of the State of New Jersey, U.S.A., without regard to its conflict-of-law principles. Any dispute arising out of or relating to these API Terms or the APIs will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
We may update these API Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be communicated via the SeaLegs AI website or the developer portal. Your continued use of the APIs after a change takes effect constitutes acceptance of the updated API Terms.
