Widget Terms of Use

1. Introduction

These Widget Terms of Use ("Widget Terms") govern your installation and use of the SeaLegs Tide Widget (the "Widget") — including the JavaScript embed, the chart iframe, the map iframe, and the official SeaLegs Tides WordPress plugin — provided by SeaLegs LLC ("SeaLegs LLC," "we," "our," or "us").

By embedding, installing, or otherwise displaying the Widget on any website, application, or service that you own or control ("Your Site"), you agree to these Widget Terms. If you do not agree, do not embed the Widget.

These Widget Terms supplement, and do not replace, our general Terms of Service and Privacy Policy, which also apply.

Important Safety Disclaimer

The Widget is for general informational purposes only and is not suitable for navigation or any safety-critical use. Tide predictions are produced from harmonic models and historical data; actual water levels can vary significantly due to weather, atmospheric pressure, wind, currents, storms, and other factors not modeled by the Widget.

The Widget is intended for general planning of recreational coastal activities — for example, surfing, beachgoing, fishing, paddling, photography, or scheduling. Do not use the Widget for vessel navigation, life-safety decisions, or any activity in which inaccurate tide information could result in injury, death, or property damage. For any such purpose, you must consult the official tide tables published by the U.S. National Oceanic and Atmospheric Administration (NOAA) at tidesandcurrents.noaa.gov, or the equivalent official authority in your region, together with current local marine forecasts, notices to mariners, and properly maintained navigational charts.

You assume the entire risk associated with use of the Widget and its data. You agree that you will not display, describe, or represent the Widget to any visitor of Your Site in a manner that suggests it is suitable for navigation or other safety-critical use, and you agree to keep visible any safety disclaimers that the Widget itself displays.

2. License Grant

Subject to your continued compliance with these Widget Terms, SeaLegs LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, royalty-free license to embed and display the Widget on Your Site solely as delivered by SeaLegs LLC.

This license is for the Widget as a whole — the embedded code that loads from cdn.sealegs.ai and the data served from api.sealegs.ai. It does not grant you any rights in the underlying tide prediction data, source code, or other intellectual property of SeaLegs LLC beyond what is required to display the Widget on Your Site.

3. Attribution

The Widget displays a "Powered by SeaLegs" link in its footer chrome. You agree to:

Keep the SeaLegs branding visible and unobstructed at all times.
Not modify, hide, recolor, blur, overlay, or otherwise interfere with the SeaLegs branding or the link to www.sealegs.ai.
Not represent that the Widget, the SeaLegs service, or the underlying data is your own product or service.

If you require a white-label version of the Widget without SeaLegs branding, please contact us about a paid plan.

4. Acceptable Use

You agree not to embed, install, or display the Widget on any website, application, or service that:

Promotes, distributes, or facilitates illegal activity, fraud, or violation of any applicable law or regulation.
Hosts, displays, or links to sexually explicit content involving minors, or any content sexually exploiting minors in any form.
Promotes hate speech, harassment, violence, or discrimination on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or other protected characteristic.
Distributes malware, phishing content, or other malicious code, or attempts to deceive visitors about the source or nature of the website.
Infringes any third party's intellectual property rights, privacy rights, publicity rights, or other rights.
Sells or facilitates the sale of weapons, controlled substances, or other regulated goods in jurisdictions where such activity is unlawful.
Misrepresents the SeaLegs service, the Widget, or the tide data — including, without limitation, presenting the Widget as suitable for navigation or other safety-critical use.

You also agree not to:

Modify, reverse-engineer, decompile, or attempt to extract the source code of the Widget, except to the extent such restriction is prohibited by applicable law.
Use the Widget to scrape, harvest, or systematically extract tide data, station metadata, or any other content for redistribution or resale.
Bypass, disable, or interfere with any security, rate-limit, or access-control feature of the Widget or the SeaLegs API.
Impose unreasonable load on the SeaLegs API by automating Widget requests, embedding the Widget at extreme rates, or other abusive patterns.

5. Service Availability and Changes

The Widget is provided as a free service. We may change, update, suspend, deprecate, or discontinue the Widget — in whole or in part, including any specific embed shape, parameter, or feature — at any time and without notice.

We do not guarantee any specific level of uptime, latency, or availability for the free Widget. If you require a service-level commitment, please contact us about a paid plan.

6. Data Sources

Tide predictions displayed in the Widget are derived from public data sources, including:

U.S. National Oceanic and Atmospheric Administration (NOAA) Center for Operational Oceanographic Products and Services (CO-OPS) for U.S. coastal stations.
Regional tide authorities and public datasets (including UKHO, IHO member services, EOT20, and others) for non-U.S. regions.

SeaLegs LLC is not affiliated with, endorsed by, or sponsored by NOAA or any other government or international body. Where required by the source's terms, the Widget retains attribution to the underlying data source.

7. Privacy

When a visitor to Your Site loads a page containing the Widget, the visitor's browser fetches the Widget code from cdn.sealegs.ai and tide data from api.sealegs.ai. As part of these standard HTTP requests, our content delivery network and API receive the visitor's IP address, user-agent, and the URL of the page that loaded the Widget (the HTTP Referer header).

We use this information to operate, secure, and improve the Widget — including caching, rate-limiting, abuse prevention, and aggregate usage analytics. We do not set cookies in the Widget. We do not sell visitor information.

You are responsible for disclosing the use of the Widget in Your Site's privacy policy as required by applicable law (including, where applicable, the EU General Data Protection Regulation, the California Consumer Privacy Act, and other privacy laws). Our handling of personal information is described in our Privacy Policy.

8. Disclaimer of Warranties

THE WIDGET, THE TIDE DATA, AND ALL RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SEALEGS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, SEALEGS MAKES NO WARRANTY THAT THE WIDGET WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT THE TIDE DATA WILL BE ACCURATE, TIMELY, OR SUITABLE FOR ANY PURPOSE — INCLUDING, WITHOUT LIMITATION, NAVIGATION OR ANY OTHER SAFETY-CRITICAL ACTIVITY.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SEALEGS, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, OR PROPERTY DAMAGE — ARISING OUT OF OR RELATING TO YOUR EMBEDDING OR USE OF THE WIDGET, EVEN IF SEALEGS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE THE WIDGET IS PROVIDED FREE OF CHARGE, SEALEGS' TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE WIDGET TERMS OR THE WIDGET WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those jurisdictions, the limitations above apply to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless SeaLegs LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to (a) Your Site, (b) your embedding or use of the Widget, (c) your violation of these Widget Terms, or (d) your violation of any applicable law or any third-party right.

11. Termination

You may stop using the Widget at any time by removing it from Your Site.

SeaLegs LLC may suspend or terminate your right to embed the Widget at any time and for any reason, including violation of these Widget Terms. On termination, you must promptly remove the Widget from Your Site. Sections 7 (Privacy), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and any other provision that by its nature should survive will survive termination.

12. Governing Law and Disputes

These Widget Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Widget Terms or the Widget will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Widget Terms from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. Material changes will be communicated via the SeaLegs website. Your continued use of the Widget after a change takes effect constitutes acceptance of the updated Widget Terms.
